What’s Included

Step 1: Clearance Search and Legal Memo ($1,250)

A comprehensive clearance search. We search using a proprietary method that combines professional-grade databases and AI-assisted analysis across federal, state, and common-law sources. A trademark attorney then evaluates every potential conflict and explains what it means for your mark.

A written legal memo analyzing your trademark, with our recommendations. This is a full legal memo, not a summary email. It includes:

  • A registrability rating of low, moderate, or high risk, so you know where your mark stands before you invest in filing
  • Distinctiveness analysis, which places your mark on the spectrum from generic to fanciful and explains how that affects its protection
  • Likelihood-of-confusion analysis of the specific existing marks we identify, applying the factors USPTO examining attorneys use
  • Other potential refusal grounds, such as descriptiveness, surnames, geographic terms, or failure to function as a trademark
  • Class and identification recommendations for your goods and services
  • A filing basis recommendation: whether to file based on current use or intent to use
  • Risks and recommended next steps, including what can be done to strengthen your position

Typical turnaround: 5 business days from engagement.

Step 2: Application Preparation and Filing ($750)

  • A consultation on filing strategy, class selection, and your description of goods and services
  • Preparation of your application, including drafting your identification of goods and services
  • Review of your specimen (proof of use) for use-based applications
  • Filing with the USPTO
  • Tracking your application’s status and forwarding USPTO communications to you through registration or notice of allowance

*If your mark comes back high-risk

If our legal memo rates your proposed mark as high risk, we will run a second clearance search and prepare a revised legal memo for one alternative mark at no additional charge. You then decide whether to move forward with filing. Because you pay for Step 2 only when you decide to file, you never pay the application fee for a mark you choose not to pursue.

What’s Not Included

These services are quoted separately. When one becomes necessary, we review your situation and give you a quote before doing any work.

USPTO government filing fees

These are paid to the USPTO, not to us, and are required for every application. See the fee breakdown below.

Office action responses

No office action responses are included in the flat fee, whether substantive or procedural. If the USPTO issues an office action, we review it with you and quote a fixed fee for the response.

Statements of Use and extension requests

These are required for intent-to-use applications once you begin using your mark in commerce.

Trademark Trial and Appeal Board (TTAB) proceedings

This includes oppositions, cancellations, and appeals.

Post-registration maintenance and renewals

This includes Section 8 declarations of use, Section 15 declarations of incontestability, and Section 9 renewals.

Enforcement

This includes cease-and-desist letters and responses to infringement claims.

Trademark monitoring

This is available as a separate service, described below.

Trademark Monitoring: A Separate Service

The USPTO does not notify you when someone files a similar mark, and a registration protects your brand only if you enforce it. Missing a conflicting application during its opposition period can make enforcement harder and more expensive later.

Our monitoring service watches for marks that could conflict with yours across four sources:

  • New USPTO filings
  • Marketplace use
  • Domain name registrations
  • Social media

We use AI-powered watch technology to scan these sources on an ongoing basis, but an alert is only useful if someone can tell you what it means. A trademark attorney reviews every potential conflict the technology flags, assesses whether it poses a real risk to your rights, and advises you on your options, including any opposition deadlines.

$180
Trademark monitoring

Monitoring is $180 per year per mark. It does not include enforcement action. If a conflict calls for action, we quote that work separately.

Pricing FAQ

How much does it cost to trademark a name with Misra Trademark Counsel?

Our flat attorney fee is $2,000 per mark, plus USPTO filing fees. For one mark in one class using USPTO ID Manual wording, the total is $2,350.

Is your fee charged per class?

No. Our $2,000 fee is per mark and covers any number of classes. USPTO filing fees do apply per class.

Can I order only the clearance search, or only the application?

Yes. The clearance search and legal memo is $1,250, and application preparation and filing is $750. You can engage us for either step on its own. If you choose Step 2 alone, we do not conduct or review a clearance search, so we recommend starting with Step 1.

What’s in the legal memo?

A registrability rating (low, moderate, or high risk), distinctiveness analysis, likelihood-of-confusion analysis of specific existing marks, other potential refusal grounds, class and identification recommendations, a filing basis recommendation, and our recommended next steps. It is typically delivered within 5 business days.

What if my mark comes back high-risk?

We run a second clearance search and prepare a revised legal memo for one alternative mark at no additional charge. You then decide whether to file.

Do I pay the application fee if I decide not to file?

No. You pay the $750 application fee and USPTO filing fees only when you decide to move forward with filing.

When do I pay?

The $1,250 for Step 1 is due when you sign the engagement letter. The $750 for Step 2 and the USPTO filing fees are due when you decide to file.

Are office action responses included?

No. If the USPTO issues an office action, we review it with you and quote a fixed fee for the response before doing any work.

Do you offer trademark monitoring?

Yes, as a separate service for $180 per year. It covers new USPTO filings, marketplace use, domain registrations, and social media, and a trademark attorney reviews every potential conflict flagged.

Are there any other fees?

Our fees for the services listed on this page are the flat fees shown. USPTO fees are separate and are disclosed before filing. Services listed under “What’s Not Included” are quoted separately, and only if you need them.
